Terms of Use

By accessing or using any Everywhere website, application, product, or service (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use our Services.

Everywhere reserves the right to modify these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

Everywhere is a design-led homebuilding system that designs, engineers, and coordinates modern homes. Our Services include the Everywhere platform, home model configurator, visualizer, reservation system, shop, and related tools.

Everywhere is not a general contractor. We serve as the design and system authority. Construction is performed by qualified third-party builders in accordance with our engineered plans.

Reserving a home model requires an initial $5,000 deposit charged to a credit card at the time of reservation. This deposit is fully refundable if the project does not proceed.

A formal reservation requires an additional $25,000 wire transfer payment due within 30 days of the initial deposit. The reservation is not final until the wire transfer payment is received.

Reservation fees are applied toward your project total. Everywhere reserves the right to refund and cancel a reservation at its discretion if it determines the project is not a good fit.

Upon completing your reservation, you will be invited to enter into a Design & Engineering Agreement ("D&E Agreement") with Everywhere. The D&E Agreement governs the scope, timeline, deliverables, and fees for the engineering and design phase of your project.

Work under the D&E Agreement does not commence until the agreement is fully executed and applicable fees are paid.

Everywhere offers materials packages, finishes, and products through its shop and project platform. All purchases are subject to availability, lead times, and the specific terms presented at the time of purchase.

Materials purchased through Everywhere are intended for use with Everywhere-designed homes. Everywhere does not warrant the fitness of materials for any other purpose.

All content on the Services — including home designs, engineering drawings, renderings, software, text, and trademarks — is the property of Everywhere or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Everywhere content without prior written consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@everywhereco.com if you suspect unauthorized access.

Everywhere reserves the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. Everywhere does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

Home model configurations, visualizations, and cost estimates presented on the platform are for illustrative purposes only and are not contractual commitments.

To the maximum extent permitted by law, Everywhere and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our total liability to you for any claim arising out of these Terms shall not exceed the amounts paid by you to Everywhere in the twelve months preceding the claim.

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Utah.
